PUBLIC HEARING: ORDINANCE REVISION 4/24/24 @ 6:00PM

NOTICE OF PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that a hearing will be held before the City Council of the City of St. Clair on Wednesday, April 24, 2024 at 6:00 p.m.  The Public Hearing will be held in the St. Clair City Hall Meeting Room, 304 Main Street West, St. Clair, Minnesota. 

The purpose of the Public Hearing is to discuss and solicit public input with regard to a Ordinance change as follows:

 

ORDINANCE NO.  2024-01

 

AN ORDINANCE OF THE CITY OF ST CLAIR, MINNESOTA

AMENDING CHAPTER 118: REGULATION OF PUBLIC DANCES AND SPECIAL EVENTS, SECTION 118.11 MINORS

 

 

            THE CITY COUNCIL OF THE CITY OF ST CLAIR, MINNESOTA ORDAINS:

 

            WHEREAS, that City Council wants to promote civic celebrations that bring the community together; and

 

            WHEREAS the Current City Ordinance does not allow the presence of a person under the age of twenty-one (21) to be present at a public dance, where alcohol is served, without being accompanied by a parent or guardian; and

           

            WHEREAS the City Council believes that restriction to be stricter than necessary to promote public safety,

 

 

            NOW, THEREFORE, BE IT ORDAINED by the St. Clair City Council that Section 118.11 Minors of the St. Clair City Code is amended in the following manner:

 

            SECTION 118.11       MINORS

 

(1)    No person under the age of 18 years of age may serve or sell intoxicating liquor in a licensed premise or by a permit holder.

(2)    No person under the age of 18 years of age shall be allowed to be present at a public dance where alcohol is served, sold or consumed, unless accompanied by a parent or guardian.

(3)    Person between the ages of 18 and 21 shall be allowed to be present at a public dance where alcohol is served, sold or consumed when the permit holder has put in place a system to place an armband on all attendees of the dance and the band color for person over the age of 21 shall be a different color than the band color for person between the ages of 18 and 21.

(a)    The bands must be worn in a place that easy to be seen by law enforcement.

(b)    The permit holder is required to check identifications of all attendees of the dance and confirm the age of all persons who attend.

 

            After adoption, signing and attestation this Ordinance shall be published once in the official newspaper of the City and shall become effective on or after the date following such publication in accordance with law.

Interested persons are invited to attend the Public Hearing to express their comments or comments may be submitted in writing.  Written comments may be sent to St. Clair City Hall, P.O. Box 97, St. Clair MN  56080.   Any persons who desire to be heard regarding this matter will be heard.
